Property owners, and those in possession of property, are responsible for keeping their premises free of hazardous conditions. If you are lawfully present on a property, whether it be a residential home, commercial building, store, or other premises, and are injured as a result of a dangerous condition, then you may be entitled to fair compensation for the injuries and related losses that you have suffered.

  • A woman in her 20's that was brutally beaten and raped by an intruder that entered her apartment building through a broken security gate. The building management had known about the broken gate for more than two months prior to the incident and, despite the high crime in the area, failed to make any repairs to the gate.
  • A man in his 40's who fractured his ankle and had to undergo two surgeries because he slipped and fell on an icy and snow covered sidewalk. The tenant of the property acknowledged that he failed to properly clear the sidewalk which he knew had a tendency to "ice over" because of the unique slope of the property.
  • A man in his 50's that suffered a broken wrist and ligament tears to his knee that required surgery due to a fall while exiting an improperly maintained elevator. As a result of poor maintenance (something that was well recorded in maintenance logs) the elevator was not level with the floor when the elevator's doors opened.
  • A 60 year old man who ambulated with braces and crutches because of polio, was caused to fall and fracture his hip because of a cracked and raised entrance to an apartment buidling. The testimony revealed that the nature of the condition was such that it was created over a lengthy period of time. Consequently, a jury concluded that the owner was aware of the condition and was responsible for the victim's injuries.
  • A 50 year old woman suffered multiple fractures to both legs, ankles and several vertebrae when the staircase she was descending collapsed. The testimony revealed that the property was undergoing renovations at the time of the incident and that the area that collapsed had been worked on prior to the occurrence. Thanks to the expertise of Friedman & Moses, the accident victim recovered a substantial sum from the building owner.

These are just a few examples of the premises cases that we have handled over the years.
